Squeakworks Terms of Service

Thanks for using our products and services (“Services”). The Services are provided by 10 Forward Media, LLC (“Squeakworks”).

By using our Services, you are agreeing to these terms. Please read them carefully.

It is not necessary for any recipient, user, customer, or client ("Client") of our Services to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote or estimate, then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any purchase or use of our services implies that the client has read and accepted our terms and conditions.

Estimates & Billing

Estimates are valid for 30 days and are non-binding.

Unless otherwise specified, a non-refundable fee of 50% is required up front before beginning any work as a retainer for our services, and the remaining 50% will be due upon completion of the project.

Websites will be transferred to client once final payment is received.

Estimates are based on the information provided at the time of quoting and may be subject to change if additional work is required.

Changes requested beyond the original scope of the project will be charged at our hourly rate. Additionally, the client will reimburse Squeakworks for any additional expenses of production not included in the original estimate.

Stock photography will be purchased and costs will be billed to the client. Otherwise, the client will be required to obtain the photography through their own means.

Hourly rates are $150.00 per hour.

Payment is due upon invoicing. Squeakworks accepts Visa, Mastercard, American Express, Discover, JCB, and Diners Club. Paypal accepted upon request.  Unpaid balances beyond 30 days will attract a percentage based late payment fee of 3% per month.

Quoted delivery dates may change due to unforeseen circumstances, delays in client response times or excessive design changes, etc.

Our time-frame quote is only an estimate and is not guaranteed.

Websites are designed to work with current technologies and browser versions. If future unforeseeable changes to technology or browsers cause website errors, Squeakworks can repair these quoted at our standard hourly rate.

Hourly billed services include but are not limited to: consulting, troubleshooting, design, programming, general help and website development.

Logo/Branding consists of the unique design of a mark and/or name for the entity.

Corporate Identity consists of the digital design of a business card, letterhead, and envelope.

All materials required for the production of the project that are not included in the agreed project scope will be provided by the client. These may include copy, photographs, digital media, logos and other graphics. Copy provided will be proofread and edited. Squeakworks is not responsible for proofreading and editing of materials provided by the client, unless it was otherwise agreed upon as part of the project scope.

Ownership of the designs and development ‘code’ remain property of Squeakworks until such time as all monies are received.

Squeakworks retains the right to use any designs for self promotional purposes.

Every website will display "Website by Squeakworks" in the footer with a link to our website. This can be removed upon request for a small fee.

Work that is refused by the client, or remains unpaid, will remain property of Squeakworks and cannot be used in whole or in part by the client.

Squeakworks will not be responsible for any damage, loss or liability the client or any third party may suffer. This includes loss of revenue, profits or data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Squeakworks or otherwise.

Either party may terminate our contract without cause upon thirty (30) days written notification to the other party. We may terminate this agreement immediately upon the refusal to, or inability to perform under the contract or a breach of the contract. On termination of the contract, the client's obligation to pay Squeakworks, except for services already accrued or incurred, will forthwith cease and terminate.

In the quote provided for a project, we provide the estimated time it will take to be completed. This time frame may be longer if the client fails to provide content or feedback in a timely fashion. Projects will be added to production schedule in the order retainer fees were received.

Our time-frame quote is only an estimate and is not guaranteed.

We only warrant work from Squeakworks, not third party providers. This includes hosting companies, domain services, email services, and third party plugins.

The purchaser is deemed to have read and accepted these terms and conditions on receipt of payment.

These Terms and Conditions supersede all previous representations, contracts, understandings or agreements, unless specifically agreed otherwise by both Parties, in writing.

Squeakworks reserves the right to revise these terms and conditions at any time.
